Rubbish Collection Notting Hill Service Terms and Conditions

These Terms and Conditions govern the provision of rubbish and waste collection services by Rubbish Collection Notting Hill to residential and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

1.1 Service means the rubbish and waste removal, collection, loading, transportation, sorting, and related services provided by us.

1.2 Customer, you and your mean the person, business, or organisation requesting or receiving the Service.

1.3 We, us and our mean the operator trading as Rubbish Collection Notting Hill.

1.4 Booking means a confirmed order for the Service made by you and accepted by us.

1.5 Waste means any rubbish, junk, refuse, or other materials you request us to collect, excluding any prohibited items as set out in these Terms and Conditions or under applicable law.

1.6 Contract means the legally binding agreement between you and us for the supply of the Service, incorporating these Terms and Conditions.

2. Scope of Service

2.1 We provide rubbish and waste collection services, including but not limited to household rubbish removal, garden waste collection, office and commercial clearances, bulky item removal, and other non-hazardous waste services.

2.2 The precise scope of the Service for each Booking will be agreed at the time of booking, based on the information you provide regarding the type, volume, and location of the waste.

2.3 We reserve the right to refuse to collect any items that are hazardous, prohibited by law, unsafe to handle, or which differ materially from the description given at the time of booking.

2.4 We do not provide skip hire, demolition, structural works, plumbing, electrical works, or any other services not expressly stated in the Booking confirmation.

3. Booking Process

3.1 You may request a Booking by telephone, email, or any other method we make available. When making a request, you must provide accurate information regarding:

a) The address where the waste is to be collected;

b) The type and approximate volume or weight of the waste;

c) Access restrictions or parking limitations at the collection site;

d) Any special handling requirements or risks associated with the waste.

3.2 Any quotation we provide is based on the information you supply. Quotations are estimates only and may be adjusted if, on arrival, the actual waste differs from the description given or is greater in volume or weight.

3.3 A Booking is only confirmed when we explicitly accept it and provide you with a date and approximate time window for collection. We reserve the right to refuse any booking request at our discretion.

3.4 You are responsible for ensuring that someone with authority is present at the property at the agreed time to grant access, confirm the items for removal, and make payment where required.

4. Access and Parking

4.1 You must ensure we have safe, reasonable, and lawful access to the collection address, including suitable parking for our vehicle in close proximity to the waste.

4.2 Any parking charges, permits, or fines incurred as a direct result of carrying out the Service, where you have not made suitable arrangements, may be added to your invoice and must be reimbursed by you.

4.3 If we are unable to complete the Service due to lack of access, unsafe conditions, or inadequate parking, we may treat this as a late cancellation and charge a call-out or cancellation fee in accordance with clause 7.

5. Customer Obligations

5.1 You must ensure that:

a) The waste for collection is clearly identified and separated from any items you do not wish to be removed;

b) The waste is not contaminated with hazardous or prohibited materials;

c) The collection area is safe, reasonably clean, and free from unnecessary obstructions;

d) Any fragile, sharp, or heavy items are disclosed to our staff when they arrive.

5.2 You warrant that you are the owner of the waste or have full authority from the owner to arrange its removal.

5.3 You agree not to instruct our staff to perform tasks outside the agreed Service or contrary to safety guidance or applicable law.

6. Payments and Charges

6.1 Our charges are generally based on the volume and type of waste, the labour required, and any additional services specifically requested or reasonably necessary to complete the Service.

6.2 Unless otherwise agreed in writing, payment is due in full on completion of the collection, and before our team leaves the site.

6.3 We accept payment by cash, debit or credit card, or any other payment method we notify to you from time to time. We do not accept payment by cheque unless agreed in advance.

6.4 We reserve the right to require a deposit or pre-authorisation before confirming a Booking, particularly for larger commercial clearances or where significant labour is anticipated.

6.5 If payment is not made when due, we may refuse to collect the waste, and any wasted journey or time may be charged at our standard call-out rate.

6.6 In the event of late payment, we may charge interest on the overdue amount at the statutory rate applicable in England and Wales, along with any reasonable costs incurred in pursuing payment.

7. Cancellations and Amendments

7.1 You may cancel or amend your Booking by contacting us directly.

7.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will usually be charged, unless we have incurred specific costs that cannot be recovered.

7.3 If you cancel within 24 hours of the scheduled collection time, or fail to provide access at the agreed time, we reserve the right to charge a cancellation or call-out fee to cover our time, travel, and administrative costs.

7.4 We will use reasonable endeavours to accommodate any request to change the date, time, or scope of the Service; however, such changes are subject to availability and may result in additional charges.

7.5 We may cancel or postpone a Booking due to adverse weather, vehicle breakdown, staff illness, safety concerns, or other circumstances beyond our reasonable control. In such cases, we will offer an alternative appointment time, but we will not be liable for any consequential loss or inconvenience.

8. Waste Regulations and Prohibited Materials

8.1 We operate in accordance with applicable UK waste management legislation and regulations, including the duty of care in relation to the transport, handling, and disposal of waste.

8.2 We will dispose of collected waste using licensed facilities wherever required, and will endeavour to prioritise reuse and recycling where reasonably practicable.

8.3 You must not present for collection any waste that is classified as hazardous, dangerous, or prohibited by law. This includes, without limitation, asbestos, clinical or medical waste, biological waste, pressurised gas cylinders, explosives, radioactive materials, chemicals, solvents, oils, fuels, paint tins containing liquid, and any other materials requiring specialist handling or permits.

8.4 If, upon inspection, we reasonably believe that the waste contains prohibited or hazardous items, we may refuse to collect some or all of the waste, or we may agree to proceed subject to additional charges and the involvement of specialist contractors.

8.5 You will be responsible for any penalties, fines, or claims that arise from your failure to disclose hazardous or prohibited materials, or from any breach of waste regulations caused by inaccurate information you have supplied.

9. Title and Risk

9.1 Once waste has been loaded onto our vehicle, it becomes our responsibility and we assume risk for its handling and lawful disposal.

9.2 Title in any items removed passes to us at the point of loading, and you relinquish all rights to those items unless we have explicitly agreed otherwise in writing.

9.3 We are not obliged to return any items mistakenly presented as waste once they have been removed, so you must carefully check that only unwanted items are identified for collection.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in providing the Service. However, we shall not be liable for any loss or damage arising from:

a) Your failure to properly identify items to be removed;

b) Pre-existing structural defects, wear, or weakness in buildings, fixtures, fittings, or surfaces;

10.2 You must notify us of any damage you believe has been caused by our staff as soon as reasonably practicable, and in any event within 48 hours of completion of the Service. We may request photographs, access for inspection, and reasonable cooperation in investigating any claim.

10.3 Our total liability to you in respect of any single event or series of connected events shall not exceed the total price paid or payable for the Service under the relevant Booking, except where such limitation is not permitted by law.

10.4 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot be lawfully excluded or limited.

10.5 We shall not be liable for any indirect, consequential, or economic loss, including loss of profits, loss of business, loss of opportunity, or loss of data, arising out of or in connection with the Service or these Terms and Conditions.

11. Insurance

11.1 We maintain public liability insurance and, where applicable, employer's liability insurance at levels we deem appropriate for the nature of our operations.

11.2 Our insurance does not cover items that we have not been instructed to remove, or items which you have left in or on furniture, bags, or containers that are presented for disposal. You are responsible for checking all items before our arrival.

12. Complaints

12.1 We aim to provide a reliable and professional waste collection service. If you are dissatisfied with any aspect of the Service, please contact us as soon as possible so that we can address your concerns.

12.2 We will acknowledge your complaint, investigate the circumstances, and aim to provide a response within a reasonable timeframe. Where appropriate, we may offer to remedy any proven shortcoming, which may include a partial refund or a repeat visit.

13. Data Protection and Privacy

13.1 We collect and process personal information, such as your name, contact details, and service address, for the purpose of managing bookings, delivering the Service, processing payments, and handling enquiries.

13.2 We will handle your personal data in accordance with applicable data protection laws in the United Kingdom. We will not sell your personal information to third parties.

13.3 We may share your information with trusted third party service providers where necessary for delivering the Service, processing payments, complying with legal obligations, or protecting our rights.

14. Force Majeure

14.1 We shall not be in breach of these Terms and Conditions or liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances, or causes beyond our reasonable control, including but not limited to severe weather, accidents, traffic disruption, strikes, lockdowns, or failures of utility services.

14.2 In such circumstances, we may suspend the Service and will use reasonable endeavours to rearrange the Booking at a mutually convenient time.

15. Variations to Terms

15.1 We may amend these Terms and Conditions from time to time to reflect changes in law, regulatory requirements, business practices, or the nature of the services we offer.

15.2 The version of the Terms and Conditions in force at the time of your Booking will apply to that Booking, unless a change is required by law or regulatory authority.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.

17. General Provisions

17.1 If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

17.3 You may not assign or transfer your rights or obligations under the Contract without our prior written consent. We may assign or subcontract some or all of our rights and obligations where this does not materially affect the Service to you.

17.4 These Terms and Conditions, together with the details of your Booking, constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings, representations, or agreements, whether written or oral.
